Recent reports in the national press highlighted the plight of a number of clubs who have been hit hard by HMRC in terms of alleged unpaid tax. If the reports are to be taken at face value then it once again illustrates the vulnerability of volunteers to unexpected complications resulting from their activities.
The "Meet Your MP" project being promoted by the three Conferences is a perfect opportunity for clubs to express their concerns to their local MP. If your club hasn't yet signed up to the project then we would urge you to get on board.

John Lowery
It is with great sadness that we must report the death of John Lowery, former Chairman of the Durham Coast League, and a member of the Conference Executive Committee.
John had not been in the best of health for sometime, and died on the 8th of this month. The funeral will be held on Thursday 13th, at 10.00am at Sunderland Crematorium.
John Lowery was a widely known and respected figure in cricketing circles in the North East. An umpire for many years, and long serving Chairman of the Durham Coast League, he was also a valued member of the Conference Executive Committee, where his advice was always sound and much appreciated. I also counted John as a personal friend, when back in the 1970's he became Chairman of the North East branch of the Cricket Society, during my period as Secretary.
He will be very much missed by all his friends and colleagues.

Delegation to meet the Sports MInister
A delegation from the three Conferences will meet the Sports Minister, Hugh Robertson MP on Tuesday 16th April.
At the meeting the delegation will stress the value of clubs as community assets, and highlight the problems faced by clubs throughout the country.

Conference elects first new Chairman in 36 years
Bob Cherry, Chairman of League Cricket Conference for the past 36 years stood down at the recent AGM. First elected in 1973 for one year, Bob was re-elected in 1977 and held the post continually until the AGM this year. In addition to his Chairmanship of Conference Bob was also Secretary of the Kidsgrove and District Junior League for 43 years before retiring from that role earlier this year. His contribution to cricket has been immense and was recognised by ECB in 2010 by the award of a Lifetime Achievement OSCA at Lords.
His successor as Chairman is Chris West, the President of the North Yorkshire and South Durham Premier CL, who was elected unanimously by the membership. Chris is an experienced cricket administrator who led the highly successful North Yorkshire & South Durham team in their quest for premiership status in 2012.

CASC Review
In a Ministerial Statement issued prior to the recent budget, the Minister responsible outlined plans to clarify and simplify the processes surrounding the Community Amateur Sports Club status. The government plan to introduce a consultation exercise shortly to address a variety of issue which they believe cause confusion in the system.
Conference will be submitting the views of members on this subject at the appropriate time, but changes are not expected until the end of the year at the earliest.

Bogus Cricket Agent
Information has come to light regarding a bogus cricket agent. A club in the Midlands has been targeted with a scam purporting to emanate from Sri Lanka. Clubs should be extremely wary, of potential scams.
In this instance an up front payment was requested to ensure all necessary documentation could be prepared, using an address for payment in the USA.

Guidelines on Social Media Abuse
We have heard over a period of time about various instances of abuse using social media sites. The DPP has now issued interim guidelines on when the Crown Prosecution Service should prosecute. Whilst the guidelines are effective immediately, the DPP has set up a consultation period for interested parties to submit their thoughts on the problems.
The consultation period runs until 13th March so if any members wish to comment they can do so either directly or through Conference, who will collate comments and send a suitable response.

Good news for Club Officials
The Court of Appeal in the case of JGE v Trustees of the Portsmouth Roman Catholic Diocesan Trust has confirmed that in most circumstances Club Officials cannot be made vicariously liable for the actions of their amateur players. The principle of vicarious liability is most commonly associated with the employer-employee relationship whereby an employer can be made liable for the civil wrongs committed by an employee. The background to this decision is a 2008 ruling of Gravil v Carroll and Redruth RFC which stated that Club Officials could not be liable for the actions of a player unless that player is under contract to a Club. That decision has been confirmed following the Appeal hearing in the JGE case. At first instance the Court had suggested that Club Officials could be held liable for the actions of their amateur players.
So for example if i had been given out LBW to the first ball of the 2013 season, hit the umpire with my bat and then smashed up the Away team dressing room, my Club Officials would not, based on the above case, be personally liable for my actions. Not that I would ever conduct myself in such a manner, however bad the decision!!h

Next Meeting - 9th March
The next quarterly meeting of Conference will be held at Middleton Cricket Club on Saturday 9th March, and will include the AGM.
Nominations for the official positions should be presented to the Secretary by 20th February.

Conferences to meet politicians
The long awaited meeting with MPs will now take place at the Houses of Parliament on 14th January. The three Conferences will present their views on the current problems facing cricket clubs around the UK and provide a view on the impact, positive or otherwise, of legislation and how it affects clubs.

Small Charitable Donations Act
The Small Charitable Donations Bill became law recently and will come into force in April. It will be of particular benefit to CASC clubs, who can lump together small donations previously exempt from gift aid, to gain the additional benefit of gift aid. Details can be found in our recent Legal Updates now included within our Members Only page.
National Club Strategy -Regional Launch
ECB launched their Club Strategy last October in an event at the Oval. To assist those leagues that couldn't attend two regional launches have now been arranged, to which representatives from member leagues of League Cricket Conference are welcome to attend.
